Years ago, the courtroom was the only place to seek redress when one party felt wronged by another. But today, court dockets are packed, attorneys’ fees and other costs of mounting a trial are more than most people can afford. In many cases, the matter itself cannot justify this expense. With trial delays and uncertain outcomes and lengthy and costly appeals, litigants now turn in many instances to alternative dispute resolution formats such as mediation. In many cases, mediation is required by the Courts.

METHODOLOGIES THAT REALLY WORK
Mediation and arbitration are the two primary alternatives. Both approaches seek to resolve serious disagreements and conflicts without involving a courtroom, judge, or jury.
Mediation is effective in resolving many kinds of disputes, be it in the area of workers’ compensation, personal injury, employment and labor disputes, real estate issues, and issues surrounding divorce and family law issues.
In mediation, the parties present their side of a case or dispute, meeting all together or not, and make an offer of resolution. This is countered by the other side and the mediator goes back and forth between the parties encouraging new offers and counter offers that move the process along.
Mediation is nonbinding. If the parties do not reach a resolution, they proceed with pending litigation or further negotiations between the parties to reach an agreement.
Arbitration is different from mediation in that the neutral third party makes an actual decision. The arbitrator issues a ruling that the parties agreed ahead of time to abide by.
